Learners’ T&C - Care Leaders Online (TCLO) E-Learning Platform

TCLO is owned and operated by The Care Leavers Online Ltd, hereafter TCLO Ltd.

Welcome to Care Leaders Online (TCLO) E-Learning Platform! These T&C (Terms and Conditions) govern your use of the TCLO E-learning Platform, hereafter “Platform”, so please read them carefully. By accessing or using TCLO’s E-learning Platform, you agree to be bound by these T&Cs.

Acceptance of terms: By using the Platform, you agree to these T&Cs. If you do not agree with any part of these terms, you may not access or use the Platform.

User eligibility: TCLO’s E-learning Platform’s content is available only to individuals who are at least 18 years old. By using the Platform, you represent and warrant that you are at least 18 years old.

Account registration: In order to access certain features of the Platform, you are required to create an account. To register an account you must use your professional email address; personal email accounts are not permitted for this purpose. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Learners’ conduct: A learner is an individual who uses the Platform for educational purposes. As a learner, you agree to use the Platform only for lawful purposes and in accordance with these T&Cs. You agree not to:

a. Violate any applicable laws or regulations;

b. Infringe on any intellectual property rights;

c. Use the Platform to transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature;

d. Attempt to gain unauthorised access to the Platform or any unauthorised access to the Platform’s content or other users' accounts;

e. Interfere with or disrupt the Platform;

f. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

CPD certification: Successful completion of CPD-accredited courses is necessary to attain the CPD certificate. Please be advised that TCLO Ltd. does not administer CPD certificates directly. Any delays in certificate issuance are the responsibility of the issuing organisation and not attributable to TCLO Ltd.

Support services: During the membership period, TCLO Ltd. commits to providing learners with reasonable technical support. This support encompasses aiding in platform access and offering guidance on platform utilisation. Video guides and Word documents are readily accessible to address common issues. Please note that assistance with personal computers is beyond the scope of our support services.

Content: The Platform may include content provided by third parties. TCLO Ltd. does not control or endorse any third-party content and disclaims any responsibility for such content. You agree that TCLO Ltd. is not responsible for the accuracy, completeness, or usefulness of any third-party content.

Content usage agreement: By accessing the Platform, you agree that the content provided therein is solely for your personal educational purposes. You agree not to view content from the platform in group settings, as access is restricted to the individual account holder. Furthermore, you further agree not to copy, reproduce, distribute, or share any of the content accessed through the Platform without prior written consent from TCLO Ltd. Unauthorised distribution or sharing of content may result in legal action. You acknowledge that the content provided on the Platform is the intellectual property of TCLO Ltd. or its licensors and is protected by copyright laws. Any unauthorised use of the content may violate these laws.

Intellectual property: All intellectual property rights related to the content of the Platform and the content provided therein are owned by TCLO Ltd. or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal and non-commercial use only.

Fees: Features of the Platform are available for a fee. By accessing or using such features, you or your organisation agree to pay the applicable fees.

Auto-renewal: The contract for services shall continue automatically after the Initial Contract Period for the same period (“Renewal Period”) unless terminated by either party giving a minimum of 30 days written notice to expire at the end of the Initial Contract Period or any subsequent Renewal Period.

Free trials will not be renewed automatically. If you wish to purchase membership to the Platform after the free trial expires, contact us at hello@thecareleaders.com.

Privacy: TCLO Ltd.'s Privacy Policy governs the collection, use, and disclosure of your personal information. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

Termination: TCLO Ltd. may terminate or suspend your access to the Platform at any time if you breach any of the Learners’ T&Cs, and with or without notice.

TCLO Ltd. reserves the right to restrict or revoke your access to the Platform in the event of misconduct during live events. Behaviours such as disruptive conduct, harassment, or any actions that compromise the learning environment are deemed unacceptable. TCLO Ltd. is committed to fostering a respectful and conducive learning atmosphere for all participants. Therefore, should any behaviour contravene these principles, TCLO Ltd. retains the authority to take necessary measures, including the temporary or permanent suspension of access privileges. Your cooperation in upholding these standards is essential for the benefit of all learners and the integrity of the learning community.

TCLO Ltd. may restrict your access to the Platform if you breach these terms, including without limitation:

• A failure to make any payment due to us; or
• Failure to provide accurate information that is necessary for us to provide access to the Platform to you.

In these circumstances, we will inform you in writing with 7 days’ notice that your access to the Products will be restricted.

Modifications: TCLO Ltd. reserves the right to modify or discontinue, temporarily or permanently, content on the Platform or any part thereof with or without notice. You agree that TCLO Ltd. shall not be liable to you or to any third party for any modification, suspension, or discontinuance of such content.

Refunds: If you purchased membership individually, you can request a refund within 14 days of purchase if none of the content on the Platform has been accessed (inactive membership). If you wish to apply for a refund, reach us at hello@thecareleaders.com.

It is your responsibility to ensure that you meet the system requirements, including compatible hardware, software, telecommunications equipment and Internet service, prior to purchasing any content.

Disclaimer of warranties: TCLO Ltd.'s services are provided "as is" and "as available" without any warranties of any kind, either express or implied. TCLO Ltd. disclaims all warranties, express or implied.

Limitation of liability: In no event shall TCLO Ltd. be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, lost profits, lost data, or business interruption, arising out of or in connection with these T&Cs or your use of the Platform.

Governing law: These T&Cs shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflicts of law principles.

Jurisdiction: Any dispute, controversy, or claim arising out of or relating to this Agreement that could not be resolved through mediation, including its formation, interpretation, breach, or termination, shall be exclusively governed by and construed in accordance with the laws of England and Wales.

Dispute resolution: Any disagreement arising from or related to these T&Cs or your utilisation of the Platform will be addressed initially through mediation. In the event that mediation proves unsuccessful, the matter will be escalated to the Courts of England and Wales for resolution.

Severability: If any provision of these T&Cs is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

We are devoted to delivering a high level of service, but we do appreciate from time to time we might not get things right. Should you have any grievances, we kindly request that you forward your complaint to the EMAIL address. We assure you of our prompt attention to your concerns and commit to providing a response no later than 14 working days subsequent to their receipt.
